National Anthem Contest Official Rules
NO PURCHASE NECESSARY. YOU HAVE NOT
YET WON. VOID WHERE PROHIBITED BY LAW.
1. Eligibility.
Atlus USA, INC. (“SPONSOR") IS THE SPONSOR OF THIS CONTEST (“CONTEST”).
THIS CONTEST IS OPEN ONLY TO INDIVIDUALS WHO ARE AT LEAST 13 YEARS OF
AGE AS OF JUNE 11, 2009 AND MEET THE FOLLOWING ADDITIONAL CRITERA, AT
THE TIME OF ENTRY AND AWARD OF PRIZE: (A) ARE REGISTERED USERS OF ATLUS
ONLINE (THE “PORTAL”) ON THE INTERNET SITE WWW.ATLUSONLINE.COM
(THE “SITE”); (B) ARE
LEGAL RESIDENTS OF THE UNITED STATES AND CANADA; AND (D) HAVE AN AUTHORIZED
ACCOUNT (THE “ACCOUNT”) ON THE SITE IN THE NORTH AMERICAN REGION
(THE “REGION”) THAT IS IN GOOD STANDING UPON THE “COMMENCEMENT
DATE” (DEFINED BELOW) AND WHICH REMAINS IN GOOD STANDING THROUGHOUT
THE CONTEST PERIOD (“ELIGIBLE PARTICIPANTS”). IF YOU DO NOT MEET
ALL OF THE FOREGOING CRITERIA, YOU ARE NOT ELIGIBLE TO ENTER OR WIN
A PRIZE. Directors, officers and employees of Sponsor and any of its
affiliate companies, subsidiaries, agents, professional advisors, advertising
and promotional agencies, and immediate families and persons domiciled
with each are not eligible to enter or win any prizes. All applicable
federal, state, provincial and local laws and regulations apply. Void
where prohibited or restricted by law. This promotion may not be available
in every country. If this promotion is prohibited or restricted by law
in your country of residence, you will not be able to enter or receive
any prize.
2. Disclaimer.
Except in the event of willful or grossly negligent conduct, Sponsor
and any of its parent companies, subsidiaries, affiliates, directors,
officers, professional advisors, employees and agencies will not be
responsible for: (a) any late, lost, misrouted, garbled or distorted
or damaged transmissions or entries; (b) telephone, electronic, hardware,
software, network, Internet, or other computer- or communications-related
malfunctions or failures; (c) any Contest disruptions, injuries, losses
or damages caused by events beyond the control of Sponsor; or (d) any
printing or typographical errors in any materials associated with the
Contest, for reasons beyond Sponsor’s control. This limitation may
not be enforceable in all jurisdictions and therefore may not apply
to all Eligible Participants.
3.
Contest Period: The Contest period shall commence on Launch Day
of the game Neo Steam: The Shattered Continent (the “Commencement
Date”) and shall continue until (3) three weeks after ending on July
2, 2009 at 5 PM PACIFIC. Winners will then be selected and announced.
4. Entry and Determination of Winner.
There will be two winners of the Contest. The Contest will
take place where creativity and effort in producing a National Anthem
song for either the Rogwel Nation or Elerd Nation will be judged. Members
of the Site who partake in Neo Steam: The Shattered Continent and produce
a song that is 30 seconds to 2 minutes long with relevance to the game’s
story/mood/setting, creativity, and ability to instill national pride
will be considered as Eligible Participant. Entry into the contest and
awarding of any prize is subject to your agreement to these Official
Rules.
5. Prizes.
Each Winner will receive:
One (1)
Official Neo Steam T-Shirt (No retail value)
One (1) Official Double-Sided Neo Steam Poster (No retail value)
One (1) In-game item- Microphone(Last 2 weeks- Valued at 1,400 Atlus
Crowns)
Prize is not transferable. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED
WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF
THE WINNER. The prize winner may be required to execute an affidavit
or certificate of liability release and eligibility release before award
of any prize. The winner may be required to show proof of eligibility
before award of the prize. If any winner cannot be reached for any reason,
or fails to respond or return the appropriate documentation within fourteen
(14) days, prize will be forfeited and awarded to an alternate winner
if there is sufficient time to do so. No substitutions or exchanges
(including for cash) of any prizes will be permitted, except that Sponsor
reserves the right to substitute a prize of equal or greater value for
the prize in its sole discretion. All prizes are awarded "AS IS."
In the event that any individual winner is under the age of majority
at the time the prize is awarded, the prize will be awarded to the winner’s
parent or legal guardian, and the parent or legal guardian will be required
to execute all required documents hereunder on behalf of the winner.
IN ANY EVENT, NO PERSON MAY ENTER OR PARTICIPATE IN THE
CONTEST UNLESS THEY WILL BE 13 OR OLDER AS OF
JUNE 11, 2009.
6. Decisions of Sponsor.
The decision of the Sponsor is final with respect to all matters involving
this Contest. Winners will be notified by e-mail (or any other appropriate
method) promptly after determination by Sponsor.
7. Collection of Information.
Entry into the Contest requires you to enter your e-mail address and
country of origin. By entering the Contest, you consent to Sponsor’s
use of this information, as well as your name, image, Likeness and biographical
information in connection with the Contest as well as for advertising,
marketing and publicity purposes in connection with the Contest or the
Game, in any and all media now or hereinafter invented, throughout the
world in perpetuity. You are informed that the personal data collected
in connection with the Contest will be collected by the Sponsor's servers
and computer systems which are based in the USA, and such collection
will therefore be subject to applicable US laws. Upon request, you will
be provided with access to your personal data. You also have a right
of opposition to the data collection, and to oppose the collection of
such personal data under certain circumstances. Controller is Atlus
USA and the data recipient is Atlus USA. To exercise such right, you
may write to “Atlus Online Re: National Anthem Contest – Personal
Data”, 5405 Alton Parkway, Suite A216, Irvine, CA, 92604. You may
also withdraw your personal data upon request; however you will be disqualified
as a entrant in the Contest if you withdraw your personal data prior
to the determination and fulfillment of the prize. Sponsor reserves
the right to terminate further entry in the Contest if technical difficulties,
including but not limited to infection caused by computer virus, bugs,
tampering, unauthorized intervention, fraud or other technical failures,
compromise the integrity or ability to continue such entry. Unless otherwise
set forth herein, Sponsor’s Privacy Policy located at https://secure.atlusonline.com/privacy.html shall apply to this Contest; provided, however,
in the event of any discrepancy or inconsistency between or among the
privacy policy and these rules, these rules shall govern.
8. General Release.
By entering the Contest, you release Sponsor, participating sponsors
and any of their respective parent companies, subsidiaries, affiliates,
directors, officers, employees and agencies (collectively, the "Released
Parties") from any liability whatsoever, with the exception of
liability for breach of its obligations under these Rules, willful conduct
and gross negligence and death or personal injury. You also waive any
and all causes of action, related to any claims, costs, injuries, losses,
or damages of any kind arising out of or in connection with the Contest
or delivery, misdelivery, acceptance, possession, use of or inability
to use any prize (including, without limitation, claims, costs, injuries,
losses and damages related to personal injuries, death, damage to or
destruction of property, rights of publicity or privacy, defamation
or portrayal in a false light), whether under a theory of contract,
tort (including negligence), warranty or other theory, to the extent
permitted by law except to the extent that any death or personal injury
is caused by the negligence of the Sponsor or any claim arises out of
Sponsor's breach of these Rules. You further indemnify and hold harmless
the Released Parties from and against any and all third-party claims,
liabilities, costs and expenses (including attorneys' fees reasonably
incurred) arising out of or related to (a) any breach or alleged breach
or violation of these rules by you, (b) your acceptance, use or misuse
of any prize or parts thereof, and (c) your participation in this Contest.
9. Winner List; Rules Request.
Winner will be posted online at http://www.atlusonline.com. For a copy of the winner list, send a stamped,
self-addressed, business-size envelope after the Commencement Date and
before 30 days following the Commencment Date to Sponsor at the following

92604. To obtain a copy of these rules, send a stamped, self-addressed

The Shattered Continent National Anthem Contest Copy of Official Rules,
c/o Atlus USA, 5405 Alton Parkway Suite A216, Irvine, CA, 92604. Residents
of the state of Washington, United States and Canada may omit return
postage for rules and winner list requests. The winner list and rules
will also be available on www.atlusonline.com during such time.
10. Miscellaneous.
The Contest and these Official Rules will be governed, construed and
interpreted under the laws of the United States. Entrants agree to be
bound by these Official Rules and by the decisions of Sponsor, which
are final and binding in all respects. Sponsor reserves the right in
the event of unforeseen circumstances beyond its control to change these
Official Rules at any time and to suspend or cancel the Contest or any
Eligible Participant’s participation in the Contest should viruses,
bugs, unauthorized human intervention or other causes beyond Sponsor's
control affect the administration, security or proper play of the Contest
or Sponsor otherwise becomes (as determined in its sole discretion)
incapable of running the Contest as planned. Eligible Participants who
violate these Official Rules, tamper with the operation of the Contest
or engage in any conduct that is detrimental or unfair to Sponsor, the
Contest or any other entrant (in each case as determined in Sponsor's
sole discretion) are subject to disqualification from entry into the
Contest. Sponsor reserves the right to lock out persons whose eligibility
is in question or who have been disqualified or are otherwise ineligible
to enter the Contest. In case of dispute, entries will be declared made
by the authorized account holder of the e-mail address submitted at
the time of entry. “Authorized account holder” is defined as the
natural person who is assigned to an e-mail address by an Internet Access
Provider, on-line service provider, or other organization (e.g., business,
educational institution, etc.) that is responsible for assigning e-mail
addresses for the domain associated with the submitted e-mail address.
Automated entries are prohibited, and any use of such automated devices
will cause disqualification. If at any time any provision of these Official
Rules is or becomes illegal, invalid or unenforceable in any respect
under the law of any jurisdiction, the legality, validity or enforceability
in that jurisdiction of any other provision of these Official Rules
shall remain unaffected. Sponsor shall act reasonably with respect to
all decisions that are within its authority to make under these Official
Rules. In the event that any dispute arises regarding the meaning or
interpretation of these Official Rules, participants agree that the
dispute shall be resolved by applying the laws of California and that
it shall be resolved by and within the courts of Orange County, California,
and you consent to the exclusive jurisdiction of, and service of process
by, such Courts for the purpose of resolving any disputes, and further
consent to the propriety of venue in such Courts.
